Article 1 – Subject matter

These general terms and conditions apply to the sale by SBC TRADING, 3 route de Chauny 02700 Amigny Rouy, France, of spare parts and accessories for motorcycles and motorized vehicles.

Article 2 – Price

The prices of our products are indicated in euros including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding handling and shipping costs.

In the case of an order to a country other than mainland France, you are the importer of the product(s) in question. Customs or other local taxes, duties, or state taxes may be due. These duties and amounts are not the responsibility of the company and cannot be paid by the company.

They are at your expense and are your own responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We recommend that you check with your local authorities about these aspects.

All orders, regardless of their origin, are payable in euros.

SBC TRADING reserves the right to change its prices at any time, but the product will be invoiced based on the price in force at the time of validation of the order and subject to availability.

The products remain the property of SBC TRADING until full payment of the price.

Waiting: As soon as you take physical possession of the ordered products, the risk of loss or damage to the products passes to you.

These terms and conditions can be consulted without the need to register an account on our website.

Any order confirmation implies your full acceptance of these general terms and conditions of sale, without exception or reservation.

All the details provided and the registered confirmation are considered proof of the transaction.

You declare that you are fully aware of it. The order confirmation is considered to be the signature and acceptance of the actions performed.

You will receive an overview of your order details via the e-mail address of your order confirmation.

Article 4 – Payment

Validating your order implies for you the obligation to pay the price indicated.

The payment of your purchases on our website is made by credit card via the secure system, by cheque, bank transfer or PayPal.

The payment of your purchases for a telephone order is made by credit card, a system that is not secure because the customer must indicate the card numbers, the expiry date and the cryptogram. This data is not stored and is only used for the purpose of fulfilling this order.

The card will be charged at the time of registration of the order.

In the case of split deliveries, the entire order will be debited on the day of the order.

Article 5 – Repeal

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.

Returns must be made in original condition and complete (unopened and undamaged packaging, accessories, instructions). In this context, you are liable. Any damage suffered by the product on this occasion may be of such a nature as to nullify the right of withdrawal.

You are responsible for the shipping costs of the return shipment.

In the event of the exercise of the right of withdrawal, SBC TRADING will refund the amounts paid, within 14 days of notification of your request and using the same means of payment as the one you used to place the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:

• The provision of services that have been fully performed before the end of the withdrawal period and whose execution has begun after the express prior consent of the consumer and the express waiver of his right of withdrawal.
• The supply of goods or services the price of which depends on fluctuations in the financial market beyond the trader's control and which are likely to occur during the withdrawal period.

• The delivery of an item for which a return authorization has been granted, a product that has been returned in accordance with the provisions of article L.121-21 of the Consumer Code and that has been delivered to us damaged. The customer as the sender assumes responsibility for the correct delivery of the product he returns.

Article 6 – Availability

Our products are offered as long as they are visible on the site and within the limits of available stocks. For products that are not in stock, our offers are valid subject to availability from our suppliers.

In the event that a product is not available after placing your order, we will notify you by email and/or telephone.

Your order will be automatically cancelled and you will be refunded to the payment method you used to pay for your purchase.

In the event of a stock shortage, a logistics solution is found as quickly as possible and the customer receives his order within a maximum of 30 days or is refunded

Moreover, the website is not intended to sell its products in large quantities. SBC TRADING therefore reserves the right to refuse orders of more than 15 identical items without prior consultation.

Article 7 – Delivery

The products will be delivered to the delivery address indicated during the ordering process, within the time indicated on the checkout page.

That is 48 hours for France (excluding Saturdays, Sundays and public holidays) by Colissimo and registered letter for the carrier La Poste for items available at the time of ordering. Some items that are too large (length X width x height = 151 cm or more) or too heavy (>30 kg), as well as products shipped outside France, cannot be shipped by the carrier La Poste in accordance with the general terms and conditions of use of the Colissimo tracking service, and must be delivered by the carrier DHL, GLS, Chronopost,  UPS and can be shipped from our warehouse or directly from our wholesaler's depot.

The delivery time is then 48 to 72 hours (not including Saturdays, Sundays and public holidays). This period can be extended in case of unavailability of products that are part of a batch.

In the event of a delay in shipping, you will receive an email informing you of a possible impact on the delivery time indicated to you.

In accordance with the legal provisions, in the event of a delay in delivery, you have the option of cancelling the order under the conditions established in article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will refund the product and the shipping costs under the conditions of article L 138-3 of the Consumer Code.

In the event of deliveries by a carrier, SBC TRADING cannot be held responsible for late delivery due solely to the unavailability of the customer following several appointment proposals.

Article 8 – Warranty

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for in articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it can be returned, exchanged or refunded.

The language of this contract is French. These terms and conditions of sale are subject to French law. In the event of a dispute, the French courts alone have jurisdiction.
