GENERAL TERMS AND CONDITIONS OF SALE SKP MOTORS SKP MOTORS is a sole proprietorship with its registered office at 3 route de Chauny, 02700 Amigny Rouy, France, registered with the RCS (Trade and Companies Register) of Saint Quentin under number 98822269100012 Phone number: +33 6 07 12 77 65 General Terms and Conditions of Sale for products sold on www.db-parts.com Article 1 – PurposeThese terms govern the sale of motorcycle parts and powered vehicle accessories by SKP MOTORS, 3 route de Chauny, 02700 Amigny Rouy, France. Article 2 – PricesOur product prices are listed in euros including all taxes (VAT and other applicable taxes on the order date), unless stated otherwise, and do not include processing and shipping fees. For orders shipped outside mainland France, you are considered the importer of the product(s). Customs duties or other local taxes, import duties, or state taxes may be required. These fees are not the responsibility of the company and will not be paid by SKP MOTORS. You are solely responsible for such charges, including any declarations and payments to the competent authorities in your country. We advise you to consult your local authorities regarding these matters. All orders, regardless of origin, are payable in euros. SKP MOTORS reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time the order is confirmed, subject to availability. Products remain the property of SKP MOTORS until full payment is received. Important: Once you physically receive the ordered products, the risk of loss or damage is transferred to you. Article 3 – Order ValidationPlacing an order on the website implies full acceptance of these General Terms and Conditions of Sale. Phone orders also imply acceptance of the current Terms and Conditions available on www.db-parts.com. These conditions are accessible without the need for an account. Order confirmation constitutes full and unconditional acceptance of these terms and conditions. All information provided and the recorded confirmation will serve as proof of the transaction. You acknowledge full awareness of this. The confirmation of the order will serve as a signature and acceptance of the transaction. A summary of your order details will be sent to the email address you provided. Article 4 – PaymentPlacing an order obligates you to pay the specified price. Online payments are made by credit card through a secure system, or by cheque, bank transfer, or PayPal. Telephone payments are made by credit card and are not secured; the client must provide card number, expiry date, and CVV. These data are not stored and are only used for that transaction. Cards are charged at the time the order is recorded. In the case of split shipments, the full order amount is charged on the order date. Article 5 – Right of WithdrawalIn accordance with Article L.121-21 of the French Consumer Code, you have 14 days from product receipt to exercise your right of withdrawal without justification or penalty. Returns must be made in original condition (unopened and undamaged packaging, with all accessories and manuals). You are responsible for the condition of returned items. Any damage may void the withdrawal right. Return shipping costs are your responsibility. If you exercise your right of withdrawal, SKP MOTORS will refund the amounts paid within 14 days from your notification, using the same payment method as the original transaction. Article 6 – AvailabilityProducts are available while visible on the website and while supplies last. For non-stocked items, availability depends on suppliers. If a product is unavailable after you place an order, you will be notified by email and/or phone. The order will be automatically cancelled and refunded via your original payment method. If out of stock, we will propose a logistic solution and ship within 30 days or offer a full refund. SKP MOTORS does not intend to sell products in large quantities. Orders of more than 15 identical items may be refused. Article 7 – DeliveryProducts are delivered to the address specified during the order process within the timeframe indicated on the order confirmation page. Delivery time is typically 48 hours within France (excluding Saturdays, Sundays, and holidays) via Colissimo or tracked letter through La Poste for in-stock items. Bulky items (length + width + height ≥ 151 cm) or weighing over 30 kg, or shipments outside France, cannot be sent via La Poste and must be shipped by DHL, GLS, Chronopost, or UPS, from our warehouse or directly from our supplier. Delivery time in such cases is 48 to 72 hours (excluding weekends and holidays) and may be extended for bundled items that include unavailable products. In case of shipping delay, you will be notified via email. As per legal provisions, in the event of a delivery delay, you may cancel the order under Article L 138-2 of the Consumer Code. If you receive the product after cancellation, we will refund both the product and delivery costs under Article L 138-3. SKP MOTORS cannot be held responsible for delays due to customer unavailability after multiple delivery attempts. Article 8 – WarrantyAll products are covered by the legal warranty of conformity and warranty against hidden defects under Articles 1641 and following of the French Civil Code. Defective products may be returned, exchanged, or refunded. All claims must be made by email within 30 days of delivery. Claims must include at least 3 photos as attachments, sent to: stephane-blanquart@sbc-trading.fr Products must be returned in the original condition with all components (accessories, packaging, manuals). Shipping costs will be refunded based on invoiced rates; return shipping costs will be refunded upon receipt of proof. This article does not affect the right of withdrawal under Article 5. Article 9 – LiabilityProducts comply with French law. SKP MOTORS is not liable if the product does not comply with the laws of the destination country. You are responsible for verifying import regulations. SKP MOTORS is not liable for damage resulting from product misuse. SBC TRADING is not liable for any issues arising from Internet usage, such as service interruption, external intrusion, or viruses. Article 10 – Governing Law and DisputesThe contract language is French. These terms are governed by French law. In the event of dispute, only French courts have jurisdiction. Article 11 – Intellectual PropertyAll elements of www.db-parts.com are the exclusive intellectual property of SKP MOTORS. No one is authorized to reproduce, exploit, redistribute, or use any part of the site, whether software, visual, or audio, without express written consent. Simple or hypertext links are strictly prohibited without express written authorization. Article 12 – Personal DataSKP MOTORS reserves the right to collect personal data. This information is necessary to manage your order and improve service. Data may be shared with partners involved in order fulfillment, payment, or service management. Data is also retained for security and legal compliance. In accordance with the French law of January 6, 1978, you have the right to access, rectify, and oppose the use of your personal data, directly via the website. Article 13 – Record KeepingSKP MOTORS will archive order forms and invoices on reliable and durable media, considered a true copy under Article 1348 of the Civil Code. Digital records maintained by SKP MOTORS will be accepted by all parties as evidence of communications, orders, payments, and transactions.
